Nature of Services
Tri-State Home Care Services and its affiliated entities (collectively, "Tri-State Home Care," "we," "us," or "our") provide non-medical in-home care services to clients in West Virginia, Maryland, and Pennsylvania. Our services include but are not limited to personal care assistance, companionship, homemaking, meal preparation, medication reminders, and other activities of daily living support. All services are provided by trained caregivers under the supervision of our management team.
Licensure and Regulatory Compliance
Tri-State Home Care Services operates in accordance with all applicable federal, state, and local laws governing home care agencies. Each state entity maintains the necessary licenses, certifications, and registrations required by their respective state regulatory authorities. We comply with regulations established by the West Virginia Department of Health and Human Resources, the Maryland Department of Health, and the Pennsylvania Department of Human Services.
Employment Practices
All caregivers employed by or contracted through Tri-State Home Care Services undergo comprehensive background checks, reference verification, and skills assessment prior to placement. We comply with all federal and state employment laws, including the Fair Labor Standards Act (FLSA), the Americans with Disabilities Act (ADA), Title VII of the Civil Rights Act, and applicable state labor regulations. Privacy and Confidentiality

Limitation of Liability
While Tri-State Home Care Services strives to provide the highest quality of care, we do not provide medical services, nursing care, or medical diagnosis. Clients requiring skilled nursing or medical intervention should consult with licensed healthcare professionals. Tri-State Home Care is not liable for medical decisions made by clients, their families, or their healthcare providers. Our liability is limited to the direct services we provide, and we maintain appropriate insurance coverage as required by law.
In the event of any dispute, our aggregate liability shall not exceed the total fees paid by the client for services during the twelve (12) months preceding the claim.
Client Responsibilities
Clients and their authorized representatives are responsible for: (1) providing accurate and complete health information; (2) maintaining a safe home environment for caregivers; (3) notifying us promptly of any changes in care needs or circumstances; (4) treating caregivers with respect and ensuring their safety; and (5) complying with payment terms as outlined in the service agreement.
Service Agreements and Termination
All services are provided pursuant to a written service agreement between Tri-State Home Care Services and the client or their authorized representative. Either party may terminate services with reasonable notice as specified in the service agreement. We reserve the right to terminate services immediately in cases of non-payment, unsafe working conditions, abusive behavior toward staff, or violation of our policies.
Payment and Billing
Payment terms are established in the service agreement. We accept various payment methods, including private pay, long-term care insurance, and applicable government programs where we are approved providers. Clients are responsible for understanding their insurance coverage and benefits. Unpaid balances may be subject to collection proceedings, and clients may be responsible for reasonable collection costs and attorney fees.
Complaints and Grievances
Tri-State Home Care Services maintains a formal complaint resolution process. Clients or their representatives may file complaints or grievances by contacting our administrative office. We investigate all complaints promptly and take appropriate corrective action. Clients also have the right to file complaints with their respective state regulatory agencies.
Insurance Coverage
Tri-State Home Care Services maintains appropriate insurance coverage, including general liability insurance, professional liability insurance, workers' compensation insurance, and such other coverage as may be required by law in each jurisdiction where we operate.

Any reference to VA services relates solely to our capacity as an independent contractor providing home care services to eligible veterans and does not imply any official partnership, sponsorship, or endorsement by the Department of Veterans Affairs.

Governing Law and Jurisdiction

Any legal action must be brought in the appropriate state or federal court located in the jurisdiction where services were provided.
